  • AI responses are not guaranteed to be correct, up to date, or contextually appropriate

  • Final decisions and actions must be taken by a human

  • You remain fully responsible for customer communications and outcomes

You must not:

  • Allow the AI to operate without reasonable monitoring

  • Use the AI in safety-critical or regulated decision-making contexts

  • Use the AI as the sole decision-maker in customer-facing processes

7. Customer Responsibilities

You are responsible for:

  • Ensuring you have the legal right to process any data submitted to our services

  • Informing your own end users about your use of AI and automation

  • Configuring Zendesk and related systems securely

  • Reviewing AI outputs before acting on them

  • Maintaining appropriate internal controls and oversight

We are not responsible for:

  • How you configure your Zendesk environment

  • How you choose to use or act upon AI outputs

  • Errors caused by incorrect inputs, configurations, or misuse

8. Suspension and Termination for Misuse

We reserve the right to:

  • Suspend or restrict access to our services or AI applications

  • Terminate usage where prohibited or abusive behavior is detected

Such actions may be taken without prior notice where required to:

  • AI-generated outputs may be similar or identical to outputs generated for other users

  • We do not guarantee exclusivity or originality of AI-generated outputs

Nothing in these Terms transfers ownership of our underlying technology, models, prompts, or systems to you.

13. Feedback

If you provide feedback, suggestions, or ideas regarding our services or AI applications, you grant us a royalty-free, perpetual, irrevocable, worldwide license to use that feedback for any purpose, without obligation to you.

14. Disclaimers

17. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Roca.work shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, business interruption, or reputational harm.

  • Roca.work shall not be liable for damages arising from:

    • reliance on AI-generated outputs

    • automated or semi-automated actions

    • configuration choices made by the customer

    • misuse or improper use of the services

Our total aggregate liability arising out of or in connection with these Terms or the use of our services shall not exceed the total fees paid by you to Roca.work in the three (3) months preceding the event giving rise to the claim.

This limitation applies regardless of the legal theory under which the claim is brought.

18. Indemnification

You agree to indemnify, defend, and hold harmless Roca.work, its affiliates, directors, officers, employees, and partners from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the services or AI applications

  • Your violation of these Terms

  • Your breach of applicable laws or regulations

  • Your failure to properly inform your end users about your use of AI or automation

  • Data or content submitted by you to the services

This indemnification obligation survives termination of these Terms.

19. Termination

We may suspend or terminate your access to the website, services, or AI applications:

  • If you violate these Terms

  • If your use poses a legal, security, or operational risk

  • If required to comply with applicable law

Termination may occur with or without prior notice, depending on the circumstances.

Upon termination:
